Blomley v Ryan (1956).
In this case Ryan who was 78 years old and under heavy influence of alcohol decided to sell his farm to Blomley. Ryan, at the time, was suffering from prolonged and excessive consumption of alcohol. Blomley have full realisation of the situation managed to persuade Ryan to sell him his farm for and unreasonably low price. (Clarke, 2013)

Courts findingThe court was able to set aside this sale due to the fact that Ryan was taken advantage of whilst under the influence of excessive alcohol, prolonged, habitual intake of alcohol and old age. Because of these factors Ryan was in no condition to make contracts and did not contain the capacity to be in a binding contract. (Clarke, 2013)
